Orange Console LLC ("we," "us," or "our") operates the Nightcap app and usenightcap.com ("the Site"). This Privacy Policy explains what information we collect, how we use it, with whom we share it, and the rights you have regarding your information. By using Nightcap you agree to the practices described here.

1. Information We Collect

Information you provide directly

  • Email address — when you join the waitlist, create an account, or contact support

Information collected automatically

  • Usage data — pages and screens visited, features used, buttons tapped, session duration, and in-app events
  • Device information — device type, operating system version, app version, and unique device identifiers
  • Crash and error data — stack traces and device state at the time of a crash or error
  • IP address and approximate location (country or region level only)

Payment information

We do not collect or store payment card numbers or billing details. All purchases are processed by Apple through the App Store. Apple's handling of payment data is governed by Apple's Privacy Policy.

2. How We Use Your Information

  • To operate, maintain, and improve the App and Site
  • To send waitlist notifications and product announcements (with your consent)
  • To send transactional emails such as account confirmations and subscription notices
  • To diagnose crashes, fix bugs, and monitor App performance
  • To analyze usage patterns and inform product decisions
  • To respond to support requests
  • To comply with applicable legal obligations

3. How We Share Your Information

We do not sell your personal information. We share data only with the following service providers who process it on our behalf:

In the event of a merger, acquisition, or sale of all or part of our assets, your information may be transferred to the successor entity. We will notify you before your information becomes subject to a materially different privacy policy.

4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services to you. If you request account deletion, we will delete or anonymize your personal information within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or enforcing our agreements).

Analytics and crash data is retained for up to 12 months and then aggregated or deleted.

5. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

6. Children's Privacy

Nightcap is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us at hello@usenightcap.com and we will promptly delete it.

  • Access the personal information we hold about you
  • Correct inaccurate or incomplete information
  • Request deletion of your personal information
  • Opt out of marketing emails at any time using the unsubscribe link in any email we send

EU, EEA, and UK users (GDPR)

Under the General Data Protection Regulation you have the right to: access your data; rectify inaccurate data; erasure of your data ("right to be forgotten"); restrict or object to processing; data portability; and to lodge a complaint with your local supervisory authority.

Our legal bases for processing are: consent (marketing emails); contract performance (operating your subscription); and legitimate interests (analytics, crash reporting, security, and product improvement).

For personal data transferred outside the EU/EEA, we rely on Standard Contractual Clauses or other appropriate transfer mechanisms recognized under GDPR.

California residents (CCPA / CPRA)

Under the California Consumer Privacy Act you have the right to: know what categories of personal information we collect and how we use or share it; request deletion of your personal information; correct inaccurate personal information; opt out of the sale or sharing of personal information (we do not sell or share personal information for cross-context behavioral advertising); and non-discrimination for exercising your rights.

Categories of personal information we collect: identifiers (email address, device ID, IP address); internet or other electronic network activity information (usage data, crash data).

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by posting a notice in the App or sending an email to the address associated with your account. Your continued use of Nightcap after changes are posted constitutes your acceptance of the updated Policy.
